We help users find and book tourist activity experiences, post opinions about these experiences, and participate in tourist activity forums. However, we are not an accommodation or travel agency, and we do not offer such experiences ourselves. When you make a reservation, you are purchasing a tour, ticket or other service directly from the third-party provider.

This Agreement is between you [“User” or “you” or “Traveller” or “Tourist”] and FROGGY TOURS CARIBE (collectively, “FROGGY TOURS CARIBE”, “we”, “us” and “our”.)

If you do not agree to all the provisions of this agreement, you may not use the Services. For the avoidance of doubt, in the event of any conflict or discrepancy between these Terms and Conditions and any other provisions and/or conditions and/or otherwise between FROGGY TOURS CARIBE and you, the provisions and conditions of these Terms of Use shall prevail. Do not hesitate to contact us if you have any questions regarding the content of this agreement.

Therefore, the use of www.froggytourscaribe.com is subject to the following terms and conditions. FROGGY TOURS CARIBE reserves the right to update the Terms and Conditions at any time without notice to the user. The Terms apply to all visitors to this website, and your access to and use of this website signifies your agreement to these Terms. FROGGY TOURS CARIBE, acts as a mere agent of the ACTIVITY PROVIDERS based in the Dominican Republic by selling acceptance services related to tourist activities, or by accepting reservations for services that are not directly provided by FROGGY TOURS CARIBE (such as sea and land transport, meals, tourist activities, etc.). FROGGY TOURS CARIBE, therefore, will not be responsible for breach of contract, non-compliance with laws such as the Dominican Republic: Law n ° 5-13 of January 5, 2013 relating to the equality of organic rights of persons with disabilities , or any intentional or negligent action or omission on the part of such suppliers, which results in loss, damage, delay, inconvenience or injury, or death of Travelers or fellow Travelers or members of the group.

You are not permitted to make any other use of the information and material on this website, including reproduction for purposes other than those mentioned above, modification, distribution or republication.   1. RISKS, CANCELLATION AND INSURANCE

The traveler assumes full responsibility for FROGGY TOURS CARIBE and hereby releases FROGGY TOURS CARIBE from any obligation to verify and verify all passport, visa, vaccination, insurance or other requirements of entry of each destination, as well as all the security and safety conditions of these destinations, during the duration of the proposed activity. However, we specifically recommend that citizens traveling abroad, including travel to the United States, United Kingdom, Canada, Mexico or the Caribbean, do so with a valid international passport. For more information on possible hazards in international destinations, contact the Dominican Republic Travel Advice Section, for health guidelines and travel restrictions.

FROGGY TOURS CARIBE shall not be liable for any injury, loss or damage related to terrorist activities, social or labor unrest, mechanical or structural integrity of sea and land transportation and any tourist activities, illness and to any instance of the Coronavirus pandemic, local laws, terrorist acts, weather conditions, natural disasters, delays, changes or cancellations of tourist activities due to weather conditions, accidents or health problems before or during transport to (by example, an accident on the way to a tour), during and after a tour, or any other action, omission or condition beyond the control of FROGGY TOURS CARIBE.

If the tourist activity plans are delayed or canceled for any reason, no refund will be made by FROGGY TOURS CARIBE.

Travelers are responsible for obtaining applicable policies, no refunds will be made for cancellations due to actual or threatened terrorist events. Additionally, there will be no refunds due to fear of travel as a result of actual or threatened terrorist, health, political or other similar events.

It is the traveler's responsibility to protect their purchases and travel insurance is strongly recommended. Travelers are advised to take out appropriate insurance against these risks. The retention by the traveler of the invoice, reservations or reservations after issuance constitutes consent to the foregoing and an agreement on his part to transmit the contents hereof to his fellow travelers or members of the group.

  1. DEPOSITS FOR TOURIST ACTIVITIES AND PAYMENT

For all reservations, FROGGY TOURS CARIBE only accepts payment by credit card and other types of payment to the chosen supplier(s) for processing/deposit. Accordingly, the supplier's deposit, payment, cancellation and refund policy/policies will be followed. The same process can be followed in the rare event that a supplier does not accept credit cards and instructs FROGGY TOURS CARIBE to process your payment and then forward the funds to said supplier(s). When booking certain tourist activities/arrangements/customized components and/or a group adventure program dedicated to FROGGY TOURS CARIBE, you will (also) receive a “Travel Policy – specific” on payments, cancellations and refunds applicable to the tourist activities in question of the segment(s) indicated on the form you receive. For such reservations/arrangements, the “Travel Specific Policy — on Payments, Cancellations and Refunds will apply in addition to all other policies provided by Suppliers, Agencies and FROGGY TOURS CARIBE. If you have two policies for the same trip, the stricter policy will apply. All payments must be made at the time of your purchase and from which FROGGY TOURS CARIBE has not received any correspondence from you, your tourist activity would be canceled and all deposits and payments you may have made would be lost.

  1. PAYMENT METHODS

All reservations are payable by credit card (Visa, Master Card, and sometimes also American Express, and Discover Card). This can be done through different platforms such as PayPal. Your reservation may be canceled (in some cases automatically!) if payment is not received by the due date.

Prices are per person based on double occupancy (unless otherwise stated) and are generally quoted in US dollars. Please see the provided itinerary for more information on what your sightseeing activity includes. Prices quoted are generally guaranteed for your tour activity, but price adjustments may be made (even on existing bookings) in the rare event of extreme currency fluctuations, post-booking fuel surcharge assessments and other events similar unforeseeable events beyond the control of FROGGY TOURS CARIBE, and/or our suppliers. Additionally, price adjustments may be assessed by the supplier(s) for currency, individual supplement, small group supplement or other reasons beyond FROGGY TOURS CARIBE's control.

Applicable to all types of reservations, there may be cases where FROGGY TOURS CARIBE will ask you to pay by check or cash.

All credit card payments, whether a payment made to FROGGY TOURS CARIBE directly or simply an authorization for us to pass your credit card information to a supplier, will require your signature on a or more credit card authorization forms provided to you. This is for your protection as well as ours. Similarly, for most transactions without a credit card, you will be provided with a “Travel Authorization” form, which we ask you to complete, sign and return to FROGGY TOURS CARIBE, before we can proceed with your reservation.

Full payment is requested at time of booking. We accept payment by credit card. Your tourist activity will be confirmed by email during your purchase.

  1. CANCELLATION/REIMBURSEMENT PROCEDURE/FEES

If you ever find yourself in the unfortunate situation of having to cancel your tourist activity, you must inform us as soon as you know that you must cancel, so that your cancellation can be processed as soon as possible. Due to various factors, we simply cannot guarantee that any cancellations and requests received by FROGGY TOURS CARIBE less than 14 days prior to a cancellation or refund deadline by a supplier, will be processed within the time frame provided. Please notify us in good time of any cancellation request via FROGGYTOURSCARIBE@GMAIL.COM.

If the tourist activity is successfully cancelled, FROGGY TOURS CARIBE will process a cancellation fee of the amount paid alongside the cancellation policies of the seller's supplier(s).

Please note that in case of bad weather, the tourist activity will be changed to another date. In case the tourist activity is postponed due to bad weather. The refund will be made at 100 %. The choice to postpone a tourist activity due to bad weather is at the discretion of FROGGY TOUR CARIBE and its suppliers.

Refunds that are due to the reduction in the number of travellers, the complete cancellation of the reservation, bad weather or for any other reason, are reimbursed at 100 %, for 14 working days, depending on the context.

YOU acknowledge that YOU have carefully read the above paragraphs as well as the “Reservations and Trip Details”, including information regarding cancellations and refunds, and by signing below, YOU fully agree to all terms and conditions therein. stated.

YOU EXPRESSLY AGREE TO RELEASE, DEFEND, INDEMNIFY, RELEASE AND HOLD OFF FROGGY TOURS CARIBE, and its harmless agents, employees, officers, directors, associates, suppliers, affiliates and contractors against any and all liabilities, actions, causes of action, damages, obligations, costs, debts, suits, claims and demands of any kind which YOU now have or which may arise out of or in connection with your tourist activity or your participation in activities organized for you by FROGGY TOURS CARIBE and its agents, employees, associates, suppliers, affiliates or subcontractors.

THE TERMS OF THIS AGREEMENT SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for myself, my heirs, assignees, administrators, executors and all members of my family, including minors accompanying me.

YOU HAVE READ AND FULLY UNDERSTAND THE TERMS AND LEGAL CONSEQUENCES OF THIS WAIVER AND ASSUMPTION OF RISKS, AND YOU HEREBY ACCEPT ALL ITS TERMS. YOU ACKNOWLEDGE THAT — HAS RECOMMENDED THAT MY ATTORNEY REVIEW THIS VERSION BEFORE I REPORT IT.

  1. PHOTOGRAPHS

PHOTOGRAPHIC DISTRIBUTION: FROGGY TOURS CARIBE may take photographs or videos of its tourist activities and the participants in the tourist activities authorize FROGGY TOURS CARIBE to do so and to use them for promotional or commercial purposes without payment of any compensation to the participant.

  1. FORCE MAJOR

Notwithstanding any other provision herein to the contrary, either party shall be excused from performance hereof for breach of any of its obligations if (i) such breach occurs by reason of any of following events (“force majeure events”): force majeure, fire, flood, storm, earthquake, tidal wave, communications failure, sabotage, war, military operation, terrorist attack, global pandemic, national emergency, mechanical or electrical failure, general postal or banking system failure, civil unrest, strikes, or the order, requisition, of a government agency or an acting governmental authority, or either party's compliance therewith, or any governmental prorogation, regulation or priority, or other similar cause beyond the reasonable control of either e or the other party and (ii) such Force Majeure Event is beyond that party's control. The party excused from performance shall be excused from performance (i) only upon notice to the party whose performance is compromised; (ii) only for the duration of the Force Majeure Event and (iii) only so long as such party continues to take reasonable steps to mitigate the effect of the Force Majeure Event and to perform substantially despite the occurrence of the force majeure event. The party whose performance is not compromised may terminate this Agreement on five (5) consecutive days' notice during a fiscal season or on thirty (30) consecutive days' notice at any other time, effective immediately upon written notice to that party.

 

  1. SAFETY RECOMMENDATIONS DURING A PANDEMIC OUTBREAK

It is prudent for ill Travelers to delay or avoid traveling to affected areas, especially for elderly Travelers and those with chronic illnesses or underlying health conditions.

The general recommendations regarding personal hygiene, cough etiquette and maintaining a distance of at least one meter from people with symptoms remains particularly important for all Travellers. These include:

  • Wash hands frequently, especially after contact with respiratory secretions. Hand hygiene includes either cleaning the hands with soap and water or with an alcohol-based hand sanitizer. Alcohol-based hand sanitizers are preferred if hands are not visibly soiled; wash hands with soap and water when visibly soiled;
  • Cover your nose and mouth with a bent elbow or a tissue when coughing or sneezing and immediately dispose of the tissue and perform hand hygiene;
  • Refrain from touching the mouth and nose;
  • A medical mask is not required if they have no symptoms, as there is no evidence that wearing a mask — of any type — protects non-sick people. However, in some cultures masks may be commonly worn. If masks must be worn, it is essential to follow best practices on how to wear, remove and dispose of them and on hand hygiene after removal (see Tips on Using Masks).

As with any travel, travelers are also advised to follow good food hygiene practices, including the five keys to food safety, as well as recommendations to reduce the risk of transmission of emerging pathogens from animals to humans in live markets.

Travelers returning from affected areas should self-monitor for symptoms for 14 days and follow national protocols of host countries. Some countries may require returning travelers to enter quarantine. If symptoms occur, such as fever, cough or difficulty breathing, travelers are advised to contact local healthcare providers, preferably by phone, and advise them of their symptoms and travel history.

All content and services on this website are provided "as is" and without any warranties, express or implied. Except for warranties implied by law and incapable of exclusion, limitation or modification, we disclaim all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.

Neither we nor our affiliated or related entities, suppliers, or anyone involved in the creation, production and distribution of this website, warrant that the functions contained in this website will be uninterrupted or error free, that the defects will be corrected or that the server that makes the content available will be free of viruses or other harmful components. The content you access on this website is provided solely for your convenience and information only. Certain products or services may be available exclusively online through the Website. These products or services may have limited quantities and cannot be returned or exchanged except in accordance with our return policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear on the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sale of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product or service we offer. All descriptions of products or product prices are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer of product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information or other materials you purchase or obtain will meet your expectations or that any errors in the Service will be corrected.

  1. ORDER AND SHIPPING CONDITIONS

Orders can be placed 24 hours a day, 7 days a week, through our website. When your order is about to be shipped, you will be notified through your registered email address, along with tracking information. There will be no further contact with you unless initiated by the customer.

(a) Price

All prices quoted through the Services are in US dollars. Taxes and other applicable fees, if any, are extra. We reserve the right to modify our offering of subscriptions and other products, and to adjust prices as we may determine in our sole discretion, at any time and without notice; provided, however, that if we change the amounts or other charges associated with your current subscription(s), we will notify you in advance by one of the means described in these terms and conditions. However, we will not be able to notify you of changes to applicable taxes before they come into effect. Shipment of the Products to you after we provide such notice will confirm your acceptance of such changes, unless you cancel your subscription(s) in accordance with the cancellation policy set out in these Terms.

(b) Taxes

We will collect applicable sales tax on products shipped to states for which we determine we have a duty to collect sales tax. If an item is subject to sales tax, you agree that the tax amount shown at checkout may be adjusted. Several factors can cause this, such as variations between processor programs and changes in tax rates.

 

(c) Shipping and handling

You agree to pay all shipping and handling charges listed at the time you make a purchase. We reserve the right to increase, decrease, add or remove shipping and handling charges from time to time, but we will notify you of the applicable charges before you make your purchase. We reserve the right to use shipping couriers if necessary. Actual delivery dates may vary. You agree not to procure or direct the shipment of any product for export.

(d) Deliveries

As a general rule, the delivery time is 2 to 5 working days after the order has been sent. However, this delay may be longer due to the inconveniences related to the ongoing COVID — 19 pandemics. We will not be liable to you in the event that delivery of your products takes longer than necessary.

If the delivered products have obvious material or production defects, including damage caused by transport, please notify us immediately by email or telephone. Failure to do so will not affect your legal rights.

You are responsible for inspecting all products you receive from us for any damage or other problems upon delivery. You should always inspect your delivery to confirm that it arrives in good condition and in the design you have asked us to build for you.

  1. LIMITATION OF LIABILITY

To the extent not prohibited by law, we and our subsidiaries, affiliates, agents and employees shall not be liable for death, personal injury, property damage or any incidental, special, consequential, punitive , exemplary or consequential of any kind or losses of any kind in any way related to your use of or inability to use our websites, however caused, regardless of theory liability, regardless of whether we knew or should have known of the possibility of such damages, including from the use or attempted use of this website or any linked site. Our liability, and the liability of our suppliers, to you or any third party in any circumstances is limited to the greater of the following amounts: (a) the amount of fees paid by you to us during the 3 months preceding the action giving liability, or (b) 0.00 $. The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this Section will survive and apply even if any of the limited remedies specified in these Terms proves to have failed of its essential purpose. The limitations of liability set forth in these Terms apply to our benefit and that of the Suppliers, and to all respective officers, directors, employees, representatives, attorneys and agents.

  1. INDEMNITY

We reserve the right to report any wrongdoing, if and when we become aware of it, to any appropriate government agency. You agree to indemnify, defend and hold harmless us and our suppliers, our and their officers, directors, employees, affiliates, agents, licensors and suppliers from and against all claims, demands, actions, costs, liabilities, losses and damages of any kind (including attorneys' fees) arising out of your use of this website, your breach of any provision of these Terms and/or any negligent act, omission or willful wrongdoing of your part. Such indemnification shall be conditioned upon our: (a) notifying you in writing of any claim, demand, action, cost, liability, loss or threat of such claim, demand, action, cost, liability, loss or threat of such action; (b) we cooperate with you in the defense or settlement of such claim; and (c) we allow you to control that defense or settlement. We shall have the right to participate in such defense at our own cost and expense.

  1. ALTERNATIVE DISPUTE RESOLUTION

FROGGY TOURS CARIBE wishes to maintain friendly relations with its travelers (agents, sellers, buyers, etc.). In order to ensure a mutually beneficial relationship, FROGGY TOURS CARIBE has set up an alternative mediation program in the event of a misunderstanding or dispute between FROGGY TOURS CARIBE and its travellers. If any dispute arises out of or relates to this Agreement, or any breach thereof, and if the dispute cannot be settled by negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the World Travel Dispute Center under applicable guidelines as established by the International Travel and Tourism Forum (IFTTA) before resorting to arbitration, litigation or any other dispute resolution procedure. If mediation is unsuccessful, the parties will settle by binding arbitration administered by the World Travel Dispute Center in accordance with applicable guidelines as set forth by IFTTA. Judgment on the award rendered by the arbitrator(s), or the written agreements of the parties, may be entered in any court of competent jurisdiction or the written agreements of the parties. If litigation is necessary to enforce this Agreement, the prevailing party or parties will receive costs and attorneys' fees. In the event of the unavailability of a qualified IFTTA mediator or arbitrator, both parties agree to submit the dispute to a mutually acceptable dispute resolution service.

The issuance of any invoice, coupon or reservation by FROGGY TOURS CARIBE is made on the express condition that: 1. FROGGY TOURS CARIBE, will not be responsible for changes in prices, rate of charges or prices initiated by the supplier (s ) or service provider(s), and 2. FROGGY TOURS CARIBE will not be liable for damages resulting from cancellations, modifications or interruptions of services and/or refunds of sums already paid or transmitted to a service provider . The initial retention of invoices, coupons or reservations by the customer after issuance constitutes consent by the customer, on his behalf and on behalf of his companions, to the foregoing. Nothing herein by Customer is intended to interfere with Customer's legal rights against any carrier or service provider.

Payment of the required deposit or any partial or full payment of a reservation on the chosen tour/package constitutes consent to all the provisions of this statement of terms and conditions as well as the provisions listed in the document “General — Reservations and Trip Details”, as well as in the document “Trip Specific — Policy on Payments, Cancellations and Refunds”, as well as all provisions contained in brochures, trip descriptions and/or itineraries, or any other form of guarantee provided to travelers in conjunction with a reservation.

FROGGY TOURS CARIBE, acts as mere agent for the Suppliers as set forth above and its agents, servants and employees, shall not be liable for any personal injury or property damage, loss or delay, or itinerary changes suffered by any person or participant in the trip resulting from the negligent act of any direct or additional air carrier or any other person or entity engaged in the transportation of the Travelers, the hotel or any other person providing any of these services, or the accommodation offered in these tours; FROGGY TOURS CARIBE shall also not be liable for any injury, death, damage, loss or delay in any means of transportation or due to any event beyond the control of TATC or any agent or supplier or force majeure. The right is reserved to refuse or accept or retain any person as a member of a trip; change a trip from "accompanied/guided" by FROGGY TOURS CARIBE, to "partially escorted/guided" by FROGGY TOURS CARIBE, or by a replacement escort, to "unaccompanied" by FROGGY TOURS CARIBE, or by a replacement escort, if the circumstances prevent the FROGGY TOURS CARIBE, the escort or the designated replacement escort from accompanying the trip for any reason; or to cancel a trip outright due to a low number of traveler registrations, illness of a service provider, default of the provider or any other circumstance beyond the control of FROGGY TOURS CARIBE .

If the contract between FROGGY TOURS CARIBE, and the Travelers, on the one hand, and/or the contract between FROGGY TOURS CARIBE, and the designated carrier, on the other hand, is terminated by the tour operator for any reason FROGGY TOURS CARIBE will not be held responsible and Travelers must request reimbursement of their travel insurance policy if they are chosen.

All prices are subject to change without prior notice. All fares quoted in applicable descriptions, itineraries and brochures are based on suppliers' current fares and prevailing international exchange rates, and are subject to adjustment without prior notice in the event of a change, and any increase resulting from such adjustment will not alter the cancellation provisions in the trip description/itinerary/brochure or in the Reservations and Tour Details document that accompanies this Disclosure Notice.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will be enforced. The headings are for reference only.

You and we deal at arm's length, creating a business relationship. We are not your agent or trustee.

The terms and conditions of these Terms, and each obligation referenced herein, represent the entire agreement between us (including the PROVIDERS) and you, and supersede any prior agreements or understandings not incorporated herein. In the event of any inconsistency between these Terms and any future posted terms of use or understanding, the latest posted Terms will control.
